ISABELA GOVERNOR-ELECT PADACA KEPT TWISTING IN THE WIND
MANILA, JUNE 1, 2004 (MALAYA) By RHOEL FERNANDEZ - The formal proclamation of Grace Padaca as Isabela governor-elect will take some time despite the resolution signed last May 28 by majority of the Comelec en banc, due to a technicality.
The signatories were Commissioners Resurreccion Borra, Mehol Sadain, Florentino Tuason and Manuel Barcelona.
Comelec chairman Benjamin Abalos said Padaca can be proclaimed only after resolution of a temporary restraining order on the proclamation issued by First Division commissioners Rufino Javier and Virgilio Garcillano. Borra, the Division's third member, dissented vote.
The TRO was based on the disqualification case filed by incumbent Faustino Dy Jr., who accused Padaca of terrorism, massive cheating, and ordering the NPA guerrillas to coerce voters to vote for her. Dy lost to Padaca by about 40,000 votes.
A hearing on the disqualification case is set on Friday.
Borra earlier argued that under Comelec rules, a case for disqualification filed after the election will be referred to the law department for investigation but proclamation shall proceed.
But yesterday he agreed that the First Division must resolve issues within its jurisdiction.
"The assumption of office is still on June 30 so there is no rush, no hurry because nobody is prejudiced."
