Manila, Aug. 25, 2000 - Pursuant to Executive Order No. 203, s. 1987, August 27, 2000, being the last Sunday of August this year, is celebrated as the National Heroes Day, a regular holiday.
The Department of Labor and Employment (DOLE) said under E.O. 203, National Heroes Day is celebrated every last Sunday of August.
Under Article 94 of the Labor Code, DOLE said, every employee covered by holiday pay law shall be paid his or her salary on said day even if no work is rendered.
An employee who is required to work on a regular holiday shall be paid a compensation double his regular daily pay or a total of 200 percent, 100 percent of regular salary plus 100 percent holiday pay, DOLE said.
When the regular holiday is also the employee’s rest day but he is required to work, he shall be paid an additional 30 percent premium pay on top of his regular holiday rate of 200 percent or a total of 260 percent, DOLE said.
Section 6 of Rule IV, Book II of the Rules Implementing the Labor Code provides for the mode of payment for absences prior to and during the holiday.
Exempted from the holiday pay law are employees in the retail and service establishments regularly employing less than 10 workers, managerial employees and field personnel.
